Data Protection statement of the PRO SKY AG

We, the PRO SKY AG (hereinafter as well called "PRO SKY"; our contact information can be found at www.pro-sky.com/en/imprint/) are pleased about both your interest in our products and services as well as your visit to our web pages.  Ensuring data protection and security for the use of our web pages is standard practice for us. We would therefore like to inform you here about what personal data we collect as you visit our web pages, and what it is used for. This data protection statement can be accessed at any time at www.pro-sky.com/en/data-privacy/, where it can be saved and printed. Since changes to legislation or to our company’s internal processes or even changes to legal regulations may make it necessary to amend this protection declaration, we would kindly ask you to read this data protection declaration on a regular basis.

 

1. Scope of application

This data protection statement applies to the internet information of the PRO SKY AG.  It can be accessed at www.pro-sky.de and www.pro-sky.com (hereafter referred to either as "our web pages" or "web services"). It does not apply to third-party web sites, not even if our web pages refer to such third-party web pages or when our information links to third party web pages.

 

2. What is personal data?

According to Art 4 No 1 of the General Data Protection Regulation (hereinafter called “GDPR”) personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data or an online identifier. Data that is impossible to use (or to use with only disproportionate effort) to establish personal information on you − through anonymization of the information, for example − is not classed as personal data.

 

3. What kind of data do we collect and process?

In principle, you can use our web pages without divulging any personal information in order to learn about our company as well as our products and their application.

Furthermore, any personal data we do use serves exclusively to enable us to offer you an extensive and interesting range of services and products and allows us to respond to your enquiries. Your personal information will not be used beyond what is indicated in this data protection declaration.  Likewise, your personal data will not be transmitted to third parties, nor will it be used for advertising purposes without your consent, except within the scope indicated in this data protection declaration, or unless we are legally obligated to divulge data or when we engage third parties sworn to professional confidentiality in order to enforce our claims. Newsletter

As part of our web services, we offer a regular subscription to our PRO SKY newsletter. When requested, the newsletter provides you with free, up-to-date information. To register with our PRO SKY newsletter service, we need your first and last name, your title, your home country, your company and the e-mail address at which you wish to receive the newsletter (all mandatory fields are indicated with *, all further information is provided voluntarily).

If you wish to subscribe to the PRO SKY newsletter, we ask that you provide us with the following declaration of consent:

"I would like to regularly receive the PRO SKY newsletter, and agree that my e-mail address, my first and last name, my title, my company and my country, as well as any data voluntarily provided, be used for this purpose. I can revoke this declaration of consent at any time by using the “unsubscribe”-link in the footer of each e-mail received form PRO SKY or via e-mail sent to marketing@pro-sky.com or by writing to PRO SKY AG, Schanzenstrasse 6-20, D-51063 Cologne, Germany, such revocation to take effect for the future. No additional fees beyond the normal transmission fees of my e-mail or internet provider shall apply. In the event that my consent is revoked, I shall not, or shall no longer, be able to receive the PRO SKY newsletter.

The collection and processing of your personal data is carried out in order to be able to offer you the newsletter which you have wished to receive. Therefore, the processing is legally based on your consent according to Art. 6 Para 1 lit. a GDPR.

 

Free downloads

As part of our web services, we offer free downloadable documents and reports on trends about the global market. In order to access the downloads offered by us, you have to register as a user of our database and agree to receive updated information via e-mail. To register with our PRO SKY download service, we need your first and last name, your title, your home country, your company and the e-mail address at which you wish to receive the newsletter (all mandatory fields are indicated with *, all further information is provided voluntarily). This data is needed to set up and manage a user account for you and to use all features of our download service. Last but not least, we also need this data in order to be able to respond to any enquiries you may have. If you wish to register with the PRO SKY download services, we ask that you provide us with the following declaration of consent:

"I agree that my e-mail address, my first and last name, my title, my company and my country, as well as any data voluntarily provided, will be stored in customer database and that particularly my e-mail address will be used to provide me with regular updates on the information I have requested to download via e-mail.

I can revoke this declaration of consent at any time by using the “unsubscribe”-link in the footer of each e-mail received form PRO SKY or via e-mail sent to marketing@pro-sky.com or by writing to PRO SKY AG, Schanzenstrasse 6-20, D-51063 Cologne, Germany, such revocation to take effect for the future. PRO SKY Find & Fly: Account creation 

As part of our web services, we offer access to information that enables you to plan and budget your next group flights. In order to access this unique online service, accessible via the following url https://findandfly.pro-sky.com/, you have to create your private account and agree to receive updated information via e-mail. To become a member of the PRO SKY Find & Fly platform, we need your first and last name, your company and the e-mail address at which you wish to receive the newsletter (all mandatory fields are indi-cated with *, all further information is provided voluntarily). This data is needed to set up and manage a user account for you and to use all features of our PRO SKY Find & Fly service. Last but not least, we also need this data in order to be able to respond to any enquiries you may have.
If you wish to register with the PRO SKY Find & Fly services, we ask that you provide us with the following declaration of consent:

"I agree that my e-mail address, my first and last name, my company, the history of my flight searches as well as any data voluntarily provided, will be stored in customer data-base and that particularly my e-mail address will be used to provide me with regular updates about the platform PRO SKY Find & Fly.

We process this data to be able to provide you with our download service based on your consent according to Art. 6 Para 1 lit. a DSGVO.

 

Double opt-in procedure

In order to verify your registration when ordering the PRO SKY newsletter, creating your own account on the platfrom Find & Fly, or registrating in order to access our free downloads, we use the “double opt-in procedure”. This means that we will only grant access to our download section, activate your account to fully access all benefits of the platform Find & Fly or send you our newsletter or other information via e-mail once you have confirmed your registration via a confirmation e-mail sent to you for this purpose, by clicking on the link contained therein. By doing this, we wish to ensure that only you yourself as the owner of the e-mail address given are able to make use of our services.  

 

4. Contact and support

General enquiries and contact requests, suggestions and recommendations, criticism or complaints can be directed to us at any time via our contact form at www.pro-sky.com/en/contact/contact-form/ or by email marketing@pro-sky.com. You can also ask us for individual product recommendations in this way.

When you use our contact form, we request that you provide us not only with the nature of your inquiry and your individual message, which you can indicate in the field with the heading "Your Message,” but also with your contact information (first name, surname and your company, your email address and telephone number). All information is strictly used to offer you the best possible advice, to respond to your wishes and requests as suited to your individual needs and, if requested, to establish contact with you. Even if you contact us by email, what information you give us is generally at your discretion.

In some cases, however, we may not be able to contact you without specific necessary information. Your personal information will be used exclusively to enable us to respond to your inquiries to your satisfaction.

We process this data in order to be able to receive and process your inquiry, Art. 6 Para 1 lit. b DSGVO.

 

5. User profile / use of cookies

Apart from the cases indicated in this data protection declaration, we do not create any personal user profiles.

In the process of retrieving the information you request from our web  site, only the data needed to provide our various services or for evaluation and security is recorded on our servers and, if necessary, stored in anonymized form (without any personal references). Insofar as we also automatically log your IP address for security reasons and to prevent attacks on our web site, this data is automatically deleted after seven days at the latest. Apart from that, we collect only general information, such as when any given content from our offering was accessed or which pages were visited the most, the names and dates requested of files, the page from which you are visiting us, the settings of the user‘s device and the name of your internet service provider. This data is analyzed to improve our offerings, and does not permit anyone to trace your personal identification.

We also use so-called "cookies", with which we hope to improve our website and adapt optimally to your needs as a visitor to our site. Cookies are small text files which are stored in your internet browser in a directory designed for that purpose.

By storing cookies, your preferred settings and other information can, for example, be saved and held ready for use on this website. When you return to this website or visit other websites that use the same cookies, the cookies are recognized along with your computer or mobile device.  None of the information saved in the cookies will allow you to be identified personally. In particular, in our customer login area you have the option of saving your preferred settings in cookies, so that you do not have to provide or re-enter information each time you use the system.

7. Protective measures to safeguard data stored with us

We are committed to protecting your privacy and to treating your personal data confidentially.

In particular, as far as possible within the sphere of our influence, we use modern encryption technology as well as numerous other measures in order to preclude unauthorized access by third parties.  Your data is stored in our data banks, which are accessible only to our specialized staff, who are specifically trained in the field of data protection. 

We would like to make you aware, however, that due to the structure of the internet, it may be possible that the data protection rules and the above indicated security measures may not be observed by persons or organizations outside our sphere of influence or responsibility. In particular, information divulged without being encrypted – even when it is emailed – can be read by third parties.  We have no technical influence over this.  It is the user’s responsibility to protect the data provided against misuse by encoding it or by using any other means.

 

8. Transfer of Data

In general, your personal data will only be transferred without your prior consent in the following cases:

If it is necessary to clarify an illegal use of our services or for legal prosecution, personal data will be transferred to the law enforcement authorities and, if necessary, to injured third parties. However, this only happens if there is concrete evidence of illegal or abusive behavior. Transfer of data may also take place if this serves to enforce conditions of use or other agreements. We are also obliged by law to provide information to certain public authorities on request. These are law enforcement agencies, authorities that pursue felony offences and tax authorities.

This data is transferred due to our legitimate interest in combating abuse, prosecuting criminal offences and securing claims. In this case your legitimate interests do not outweigh, Art. 6 Para 1 lit. f GDPR.

We are dependent on the services of contractually affiliated companies and external service providers ("data processor"). In such cases, personal data will be transferred to these data processors in order to enable them to process the data further. These data processors are carefully selected and regularly reviewed by us to ensure your privacy. The data processors may use the data exclusively for the purposes specified by us and are furthermore contractually obliged by us to treat your data only in accordance with this data protection statement and the German data protection laws.

The transfer of data to data processors is based on Art. 28 Para 1 GDPR. If European Data Protection Authorities and/or European Courts come to the conclusion that Art. 28 Para 1 GDPR is not an independent legal basis for the transfer of data to data processors, the transfer is based on our legitimate interest in the economic advantages associated with the use of specialized data processors., In these cases your rights and interests in protecting your personal data do not predominate.

 

9. Data storage abroad

We consistently ensure rigorous adherence to the binding data protection measures set by law in the European Union.

It is possible in certain cases, particularly for technical reasons, that the data you entrust to us is stored on servers outside of your country (also outside the European Union) from where you originally entered the data. In such cases, and in the event there is a risk that countries in which your data is being transferred do not have data protection laws as stringent as those within your own country or in the country from which you are accessing our services, we will ensure that your data is treated in accordance with the provisions of this data protection declaration.

In terms of data processing to the United States, the European Commission decided on 12 July 2016 that an appropriate level of data protection exists under the regulations of the EU-U. S. Privacy Shield, Art. 45 GDPR. Therefore, we use the following service providers who are certified according to the EU-U. S. Privacy Shield:

10. Hyperlinks to third-party websites

Our website has so-called hyperlinks to third-party websites of other providers. When you activate these hyperlinks you are immediately redirected to the website of the other provider. You will see this, among other things, from the fact that the URL has changed.

We take no responsibility for the confidential use of your data on these third-party websites, since we have no influence on whether these organizations observe data protection regulations. Please inform yourself directly from their websites regarding their use of personal data.

 

11. Information regarding your personal data stored by us / storage duration / deletion

We store your personal information for only as long as permitted by law. Personal data is deleted when a user revokes consent to its storage, or when the knowledge gained from this data is no longer necessary in order to fulfill the purpose of the storage, or when its storage is prohibited for other legal reasons. Furthermore, upon your request, we will gladly divulge to you which of your personal data we have stored. Should you wish to have the stored data deleted, such a deletion will also be carried out at your request. Please be aware, however, that once your data is deleted, we can no longer offer you the services described here.  

Moreover, as a data subject to the processing of personal data you have the right to claim restriction and transportability of your personal data. You also have the right to submit a complaint with the supervisory authority.

Furthermore, in cases where the data processing is legally based on Art. 6 Para 1 lit e GDPR or for the purpose of direct advertising, you have the right to object to the processing.
